Your maintenance plan auto-renews, and in California a cancel voicemail now has a one-business-day clock

The front counter of a small HVAC shop office with a black desk phone showing a lit red message light, a rubber-banded stack of carbon-copy service tickets, a clipboard of blank forms, a card terminal, van keys on a carabiner, a roll of foil tape, a boxed pleated furnace filter, and a refrigerant gauge manifold with coiled hoses, under fluorescent light with a white service van outside the window.

TL;DR: In California, a maintenance plan voicemail asking to cancel must be processed or returned within one business day. The rule applies to contracts entered into, amended, or extended on or after July 1, 2025.

California’s automatic renewal rules apply to newer HVAC plans

Most HVAC maintenance memberships, clubs, and service agreements charge a card automatically when the plan renews. In California, Assembly Bill 2863 amended the Automatic Renewal Law in Business and Professions Code sections 17600 to 17606. Governor Newsom signed it on September 24, 2024.

The amended requirements apply to a contract entered into, amended, or extended on or after July 1, 2025. Section 17602(j) sets that date.

The renewal terms cannot be buried in the general sale agreement. You must get the consumer’s express affirmative consent to the automatic renewal terms themselves. That consent is separate from agreeing to the overall sale. The renewal terms must be clear and conspicuous, in visual proximity to the request for consent.

You also cannot charge the card without that affirmative consent. Keep verification of the consent for three years, or one year after the contract ends, whichever period is longer.

A member must be able to cancel through the same medium used to sign up

California requires cancellation in the same medium the consumer used to enroll. The statute lists in-person, telephone, mail, and email.

If a member signed up online, the member must be able to cancel online. The process cannot add steps that obstruct or delay cancellation. The page must provide a prominently located direct link or button, or an immediately accessible termination email.

The rule also requires a toll-free number, email address, postal address when the business bills directly, or another cost-effective, timely, and easy-to-use cancellation method.

Find out how every current member signed up. It may have happened on a technician’s tablet in the driveway, over the phone, through your website, or on paper. Record that medium on the member record. That tells your office which cancellation paths must be available.

A California cancellation voicemail has a one-business-day deadline

Section 17602(c)(2)(B) addresses the message that can otherwise disappear into a busy office voicemail box. If a consumer leaves a voicemail requesting cancellation, the business must, within one business day, either process the cancellation or call the consumer back about it.

Plan cancellation requests tend to arrive when the renewal charge appears on the member’s card statement. They often come by voicemail after hours. In fall, those messages land beside dozens of tune-up booking and reschedule calls. A message saying, “Please cancel my plan,” can sit unheard for days while the office works through the tune-up backlog. See why fall tune-up reschedules pile up.

Dial 72’s AI receptionist answers every call 24/7, so a member calling at night reaches an answer instead of voicemail. It recognizes callers who are maintenance members and texts the owner a call summary after every call. A cancellation request appears as its own clearly labeled text that same night instead of sitting in a voicemail queue. The shop still decides and processes the cancellation itself. Dial 72 answers in English or Spanish. For other after-hours coverage choices, see after-hours call coverage options.

Save offers must come after the caller gets a clear way to cancel

Your office can present a discount, retention benefit, or information about the effect of cancellation when a member calls to cancel. That information might include the loss of priority scheduling or the member discount.

There is a specific order. Before presenting the save offer, the business must clearly and conspicuously tell the caller that the cancellation can be completed at any time by saying “cancel” or words to that effect.

Once the caller says “cancel,” process the cancellation promptly. Do not obstruct or delay it.

Write this into the office script. Prepare your AI receptionist’s call instructions before putting a script into use.

Online, a save offer is allowed only next to a continuously displayed button or link labeled “click to cancel.”

Price changes require notice between 7 and 30 days before the new charge

A material change in terms requires clear and conspicuous notice, including information about how to cancel. For a price change, the notice must arrive no less than seven days and no more than 30 days before the new price takes effect.

That window matters when October price increases affect plan pricing. Set the send date inside the required window, include the cancellation information, and keep a record of what went out. Use this October price letter checklist when the new plan pricing is ready.

The plan still has to deliver something members value. Review what the maintenance visit should include with this maintenance visit standard.

Annual reminders must show the charge and cancellation method

California also requires an annual reminder. It must disclose the product or service, the frequency and amount of charges, and how to cancel.

Send it in the same medium the consumer used to sign up, or in the medium the consumer regularly uses with the business. The reminder can ride along with the tune-up reminder if it contains the required plan and cancellation information.

The federal picture is still moving. The Eighth Circuit vacated the FTC’s “click to cancel” amendments to the Negative Option Rule in full on July 8, 2025, days before enforcement was set to begin. The court did so on procedural grounds.

On March 11, 2026, the FTC issued an advance notice of proposed rulemaking on negative option marketing. Comments closed April 13, 2026. The FTC said it had received more than 100,000 complaints in the previous five years about negative options and related practices. No new federal rule has been issued yet. Federal laws such as the Restore Online Shoppers’ Confidence Act still apply.

Put four controls in place before the next renewal cycle

First, mark each member’s sign-up medium in the record. Second, add a separate renewal consent checkbox or signature line to every sign-up form and tablet screen, then retain the verification for the required period.

Third, assign one person to monitor cancellation requests. A voicemail asking to cancel gets processed or returned within one business day in California.

Fourth, schedule the annual reminder and the 7 to 30 day price-change notice. Check with your attorney about how these rules apply to your current forms, contracts, and member records. Then test the phone, website, email, and voicemail cancellation paths yourself.
